What are the Grounds for Divorce in GA?

Georgia is a no-fault divorce state, meaning that a couple does not need to cite a reason for requesting a divorce. Rather, a no-fault divorce can be filed based on “irreconcilable differences” or that the marital union is “irrevocably broken,” meaning that there is no way of repairing the marriage.

However, couples do have the option of filing for a fault divorce. The state of Georgia recognizes 12 grounds, or reasons, for divorce:

  1. Intermarriage of two persons who are closely related to the point that the marriage may be considered incest
  2. Mental incapacity at the time of marriage
  3. Impotence at the time of marriage, with the other partner being unaware
  4. Use of force or fraud to obtain the marriage
  5. Pregnancy of the wife by a man other than the husband, with the husband being unaware
  6. Adultery of either spouse
  7. Abandonment or willful desertion of either spouse for a minimum of one year with the deserting spouse indicating no intention of returning
  8. A criminal conviction that reflects moral turpitude (behavior that violates accepted community standards), resulting in incarceration for two or more years
  9. Habitual intoxication
  10. Cruel treatment, including physical or verbal abuse
  11. Incurable mental illness, as evaluated by the court or two physicians who have examined the party
  12. Habitual drug addiction

In an equitable distribution state, assets (including funds and property) will be divided fairly but not necessarily equally.
